Acceptable Use Policy

This Acceptable Use Policy (the "AUP") governs your conduct on the CastPact Platform, including the marketplace, campaign tools, tracking links, and Performance Campaign storefronts. It is incorporated by reference into, and forms part of, the Terms of Service and the Campaign Agreement. Capitalized terms not defined here have the meanings given in the Terms of Service. Violating this AUP is a breach of the Terms and may result in content removal, withholding or clawback of payments, suspension, or account termination.
1. Prohibited Content and Conduct
You may not use the Platform to do, attempt, or enable any of the following:
- Infringe any copyright, trademark, patent, trade secret, right of publicity, or privacy right, or post content you do not own or have a license to use.
- Falsely state or imply an endorsement, affiliation, or sponsorship, or post fake, incentivized-but-undisclosed, or AI-fabricated reviews, ratings, testimonials, or engagement.
- Misrepresent audience size, reach, or performance, or use bots, click farms, fake accounts, or other artificial means to inflate metrics or attribution.
- Engage in payment fraud, attribution fraud, chargeback abuse, money laundering, or self-dealing through your own tracking links.
- Resell, redistribute, duplicate, or fraudulently obtain game keys, or sell keys you are not authorized to sell.
- Post or distribute nonconsensual intimate imagery, sexual deepfakes, content sexualizing minors, or other content prohibited by applicable law.
- Post unlawful, harassing, defamatory, hateful, deceptive, or violence-inciting content, or content that violates the rules of Twitch, YouTube, TikTok, or any connected platform.
- Introduce malware, scrape or harvest data, probe or breach security, circumvent rate limits or access controls, or interfere with the Platform's operation.
- Circumvent the Platform to transact off-platform in order to avoid fees, or impersonate any person or entity.
2. FTC and Disclosure Compliance
Creators must include clear and conspicuous, medium-matched disclosures of any material connection in all promotional content, including paid Sponsored Campaign deliverables (for example, "#ad" or "#sponsored") and Performance Campaign affiliate or commission promotions (for example, "I earn a commission on sales through this link"). Free or discounted game keys are a material connection that must be disclosed. A platform native toggle or a disclosure buried in a description alone is not sufficient. See the Campaign Agreement and the Terms of Service for the full disclosure obligations.
3. Reporting and Enforcement
To report content or conduct that violates this AUP, contact abuse@castpact.com. Copyright complaints should follow the Copyright and DMCA Policy. We may, but are not obligated to, review, remove, or restrict access to content and may suspend or terminate accounts for violations. We reserve the right to take any action we deem appropriate, in good faith, to address suspected violations, fraud, or risk to the Platform or its users, including the remedies in the Terms of Service.
4. Repeat Infringers
We maintain and enforce a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. See the Copyright and DMCA Policy.
5. Changes
We may update this AUP from time to time. Material changes will be posted with a revised "Last updated" date. Your continued use of the Platform after changes become effective constitutes acceptance.
