Copyright and DMCA Policy

CastPact LLC ("CastPact") respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA"). This Policy is incorporated by reference into the Terms of Service and works together with the Acceptable Use Policy.

1. Designated Copyright Agent

Send DMCA notices to our designated agent at copyright@castpact.com. A physical mailing address for the registered designated agent will be listed here and with the U.S. Copyright Office. CastPact LLC is an Idaho limited liability company.

2. Notice of Alleged Infringement

A valid takedown notice must include: (a) a physical or electronic signature of the copyright owner or a person authorized to act on its behalf; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to locate it (such as the URL); (d) your contact information (name, address, telephone, email); (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.

3. Counter-Notification and Put-Back

If your content was removed and you believe it was removed in error or misidentification, you may submit a counter-notification to copyright@castpact.com including: (a) your signature; (b) identification of the removed material and its prior location; (c) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address, and phone number, together with a statement consenting to the jurisdiction of the federal district court for your address (or, if outside the United States, any district in which CastPact may be found) and that you will accept service of process from the complaining party. We may restore the removed material in accordance with the DMCA unless the original complainant files a court action.

4. Repeat Infringers

CastPact maintains and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

5. Misrepresentations

Under 17 U.S.C. 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Do not make false claims.

6. Other Intellectual Property and Abuse

For non-copyright intellectual property complaints (such as trademark) or other abuse, including nonconsensual intimate imagery, contact abuse@castpact.com. See the Acceptable Use Policy.
